User Agreement

JOYGAME USER AGREEMENT

This User Agreement ("Agreement") is entered into between Joygame Game and Technology Inc. ("Joygame") and all natural or legal persons ("You", "User" or "Users") who access or provide access to the Joygame website ("Platform") with or without membership, and who obtain or benefit from any content, product, game and/or service ("Content" or "Contents") offered through the Platform in any manner, partially or completely, temporarily or permanently, in their own name and account or in the name and/or account of other persons or organizations.

By accessing the Platform or creating a membership account, you accept this Agreement. If you do not accept this Agreement, you must immediately stop using the Platform.

The User declares that they also accept the Joygame Privacy Principles, which are an integral part of this Agreement.

1. SUBJECT MATTER OF THE AGREEMENT

1.1. The subject of this Agreement is the establishment and regulation of the terms of use applicable to the Contents published, placed and accessed on the Platform that belong to Joygame or that provide access only on the Platform, and the contractual terms of use applicable to the use of the Platform or Contents by Joygame, the publisher of the Platform, and Users, whether directly or indirectly in any manner.

The Platform can only be used for entertainment purposes. The Platform cannot be used for commercial purposes, to generate income or similar objectives. The User accepts that they will use the Contents only in a non-commercial manner and for personal use.

1.2. Joygame has the right and authority to partially or completely update or modify the conditions contained in this Agreement due to changes in the Platform's content, updates to offered products or services, offering new products or services or similar reasons, and in such cases the Agreement will be presented to Users through the Platform with updates and notification.

2. USER ACCOUNTS AND ACCESS

2.1. Users may open a membership account by clicking on "Sign Up" or similar functions on the Platform. After the User enters the required information in the relevant section and successfully completes all steps, a User account will be assigned by Joygame. The User may not share their account access information or other authority with any third party, temporarily or permanently. If such unauthorized use occurs, the person or persons to whom the User account is shared may be identified by Joygame, and the relevant account may be suspended or use may be terminated.

2.2. The account owner is solely responsible for the consequences of sharing the account with persons other than the User. Any person who uses another User's account in any manner cannot make any claims or demands against Joygame. Unauthorized access and use are subject to legal sanctions to the extent they are deemed illegal by competent authorities.

3. ESTABLISHMENT AND EFFECTIVENESS OF THE AGREEMENT

3.1. This Agreement is concluded in a legally binding manner from the moment Users access the Platform with or without membership, access any Joygame publication on the Platform with or without creating account information, irrespective of the transaction, visit, or membership duration, and from this moment forward, this Agreement is deemed to have been read, understood and approved by the User and becomes effective.

3.2. After the Agreement is established in the manner and moment specified in 3.1, regardless of the time periods and durations of the User's access to the Platform, the Agreement remains legally binding as long as the User accesses the Platform and benefits from the Contents in any manner.

4. OWNERSHIP

4.1. www.joygame.com and all services and Contents offered through this Platform are owned exclusively and solely by Joygame Game and Technology Inc.

4.2. No Content obtained in accordance with the principles and rules determined by Joygame grants the User ownership rights over it. The Contents accessed or obtained by the User through the Platform are the exclusive property of Joygame.

5. INTELLECTUAL PROPERTY RIGHTS

5.1. Brands, logos, designs, marks, images, sounds, functions, codes, source codes, interfaces, buttons, shapes, colors, writings, texts, templates and other intellectual property elements used by Joygame in offering the Platform and Contents to Users are the exclusive property of Joygame.

6. PROHIBITED USES

6.1. The User accepts to use the services and Contents provided by Joygame only in accordance with the provisions of this Agreement and applicable laws. The User undertakes not to perform the following actions:

  • Affect Joygame Contents through unauthorized third-party software, automation tools, bots, hacks, mods, cheats, etc.
  • Attempt to reverse engineer, compile, decrypt, modify or copy the source code of any software
  • Collect, share or misuse other users' account information or personal data without authorization
  • Lease, transfer, share or commercialize a User account to another person
  • Engage in transactions or conduct on the Contents or Platform aimed at generating commercial profit
  • Use the Contents and Platform for illegal, fraudulent, harmful, obscene, racist, hateful or aggressive purposes

7. LIABILITY

Joygame provides no guarantees or commitments to the User regarding the Platform and Contents with respect to defects, warranty, third-party ownership, intellectual property rights, continuity, accuracy, reliability, quality, uninterrupted service, the content having a different nature than stated, or other such matters.

8. APPLICABLE LAW

The Istanbul Anatolian Courts and Enforcement Offices shall be competent for disputes arising from the implementation of this Agreement, and Joygame's records shall be accepted as exclusive evidence in disputes arising from the implementation of this Agreement. The laws of the Turkish Republic shall apply to disputes arising from the implementation of this Agreement, excluding conflict of laws rules.
